Welcome to iZen, a community marketplace to learn vocational and non- vocational courses from a professional. iZen website and service including (without limitation) www.izen.co (the “Site”) and other all websites, mobile applications and other interactive properties through which the service is delivered (collectively, the “Services”) are owned, operated and distributed by Herten Technologies Pvt Ltd., a Mumbai based organization (referred to in this Privacy Policy as “iZen” Company” or “we” and through similar words such as “us,” “our,” etc.). By accessing any part of the Services, you are agreeing to the refund policy described below. If you do not agree to any of these terms, you should not use the Services. This Refund Policy applies to all users, including both users who are using the platform to learn as well as users using the platform to teach/consult/train.
Cancellation and Refund Policies
This Policy shall, at all times be read and construed in consonance and along with the terms and conditions of the Website (the Terms of Use).
A) COMPANY REFUND POLICY IN CASE OF:
1)Workshop: Cancellation received at least 24 hours before the scheduled class is refundable or adjusted for upcoming classes. Refund process normally takes 5-7 working days and the cancellation request received before 24 hours of scheduled class is not refundable but can be adjusted with future classes.
2)Course: Due to limited seating, we request users that if you cancel at least 48 hours before a scheduled class/session, this gives us an the opportunity to fill the class. You may cancel by phone or online, if you have to cancel your class before the 48 hours of the scheduled class, we offer a credit to your account, but we do not refunds, best effort to adjust you in a class of your choice for any upcoming classes. You may use these credits towards any future class/sessions or you have an option to transfer to your known ones. The company has the only right to be flexible here.
3)Consultation: Due to consultation slots being made available after the consultant's schedule of availability suggested by themselves, if any consultations are cancelled by the consultant, full refund will be made to users who paid to receive consultation in 48 hours of cancellation.
In some cases, the payment gateway charges incurred for the refund may be recovered from the consultant.
In case the cancellation is requested by the user seeking consultation, the same needs to be conveyed 48hrs before the appointment to receive the full refund.
Users seeking consultation can reschedule consultation (48hrs before the appointment) appointment 2 times if consultants slots are available in near future. Rescheduling if done 48hrs before the appointment is free of charge.
If cancellation or rescheduling is requested less than 48hrs before the appointment, 50% refund will be given to the user.
If a user seeking for a consultation does not attend the appointment, or is late for appointment for more than 10mins, consultation will be considered cancelled and no refund will be given.
B) GOVERNING LAW AND JURISDICTION
In the event of any dispute arising between the parties with respect to this Policy, the same shall be referred to the sole arbitrator and the arbitration shall be in accordance with Arbitration and Conciliation Act of 1996. The language of arbitration proceedings shall be in English. The seat and place of arbitration shall be Mumbai, Maharashtra, India and the decision of the Arbitrator shall be final and binding on both parties herein.
This Policy shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India and shall be governed by the laws of India.
